These Terms of Use (“Terms”) govern your access to and use of the website located at njsworks.org (the “Site”) operated by NJS Works, Inc. (“NJS Works,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

About the organization

NJS Works is a nonprofit organization based in Brunswick, Maine. Information on the Site describes our mission and programs in general terms. Specific opportunities (for example, sponsorships, shifts, or participant arrangements) are subject to separate written or verbal agreements, application processes, and our policies as in effect at the time.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NJS WORKS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (IF ANY) FOR ACCESS TO THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50), EXCEPT WHERE PROHIBITED BY LAW.

Indemnity

You agree to defend, indemnify, and hold harmless NJS Works and its directors, officers, employees, volunteers, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

Governing law and venue

These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles. For any dispute arising out of or relating to the Site or these Terms, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Maine, subject to applicable law requiring otherwise.

Changes

We may modify these Terms at any time. We will post the updated Terms on the Site and update the “Last updated” date. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms, to the extent permitted by law.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NJS Works regarding the Site and supersede any prior agreements on that subject.
